Terms of Service

Last updated: October 17, 2026

The service

Fluxpoint is a CRM operated by Fluxly. These terms apply to everyone who uses it: the client company that arranges the service with us, and the people that company invites. Your company may also have a separate agreement with Fluxly covering pricing and service details; if it conflicts with these terms, that agreement wins.

Accounts

  • Fluxly sets up each client company. The company's administrators then invite their own team and are responsible for who they give access to.
  • Keep your password private and don't share your account. Each person should have their own.
  • Tell us immediately at fluxpoint@fluxly.ca if you think someone has accessed your account without permission.

Your data

Your company owns the data it puts into Fluxpoint. You give us permission to store and process it only as needed to run the service for you. You're responsible for having the right to store any personal information about your own customers and contacts, and for using it lawfully.

Acceptable use

Don't:

  • Try to access another company's data, or any account or record you're not authorized to use.
  • Upload anything unlawful, or use the service to send spam or harass anyone.
  • Probe, scrape, overload or try to get around the security or limits of the service.

Plans, seats and billing

Your company's plan decides which modules and how many seats are available. Fees and invoicing are agreed between your company and Fluxly. If fees go unpaid, we may make the account read-only or suspend it after giving notice; your data isn't deleted when that happens.

Availability and changes

We work to keep Fluxpoint available and reliable, but can't promise it will never be interrupted. We improve the service over time and may change or retire features; we'll give reasonable notice of changes that significantly affect how your team works.

Ending the service

Your company can stop using Fluxpoint at any time by letting us know. We may suspend or end access if these terms are seriously or repeatedly broken, or where needed to protect the service or other clients; where practical we'll give notice first. When the service ends we'll help you export your data on request before it's deleted.

Liability

The service is provided “as is”. To the extent the law allows, Fluxly isn't liable for indirect or consequential losses, such as lost profits or lost business, and our total liability is limited to the fees your company paid in the twelve months before the claim.

Governing law

These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada that apply there.
